Abstract

Artificial intelligence (AI) is quickly permeating several Indian industries, including healthcare, government, and finance, adding complexity to the already convoluted issue of privacy rights. Many are concerned about possible privacy invasions caused by the integration of artificial intelligence (AI) systems such automated decision-making systems, facial recognition, and predictive analytics. This study looks at the risks that AI can bring to people's privacy, specifically in India (Saeed et al., 2024).  Among the significant AI use cases covered in the research are facial recognition in law enforcement, biometric identification in Aadhaar, and data analytics for the provision of public services. Legal and ethical safeguards must be adopted immediately since technological advancements are outstripping the capacity of legislators to control them. There is a tendency for these apps to muddy the line between innovation and potential invasion of privacy. Using this approach, we can compare and contrast European Union regulations like the General Data Protection Regulation (GDPR) with Indian statutes like the Information Technology Act, 2000 and the Personal Data Protection Bill. The study uses Aadhaar and AI-based surveillance projects as case studies to examine risks and lessons learned. According to Dwivedi et al. (2019), ethical concerns are important in order to prevent societal problems and other unforeseen repercussions.  The results show that in the age of artificial intelligence, India's privacy protection laws are severely lacking in transparency, accountability, and data security. Some of the recommendations include establishing AI-specific regulations, pushing for more ethical AI research and development, and stressing the importance of responsible public use. This report highlights the significance of aligning India's AI progress with strong privacy rules. Finding a middle ground between encouraging innovation and safeguarding citizens' rights is crucial for ensuring privacy in the AI of the future.
